Disclaimer

I acknowledge that Credisa GmbH (hereinafter: the broker) will forward my application for review to Bank-now AG, Cembra Money Bank AG and Corner Bank SA (each individually hereinafter the “financing institution”) via the internet, by email or by fax/post. I also acknowledge and/or confirm the following:

Application review and credit reference data: I confirm that all the information I have provided in the application is complete, up to date and correct, and I authorise the financing institution, in connection with the review of this application and the administration of the contractual relationship, to obtain information about me from third parties, in particular banks, the Central Office for Credit Information (ZEK), authorities (e.g. debt collection, land registry and tax offices, residents’ registration offices, child and adult protection authorities), credit agencies, credit brokers, employers, group companies of the financing institution and, where applicable, the Consumer Credit Information Office (IKO). For the aforementioned purposes, I release these bodies from banking, postal, official and business secrecy respectively. I acknowledge that the financial institution may be obliged to report a consumer lease or a consumer credit to be granted or already granted to the Consumer Credit Information Office (IKO). I further authorise the financing institution to notify the ZEK of the transaction applied for and, where required by law, to report it to other bodies as well. The information reported includes, in particular, the type, amount and terms of the credit or financing, the personal details of the applicant(s) and, where applicable, qualified payment arrears or misuse. I acknowledge the right of the ZEK to provide its members with information on the data reported. The financing institution may reject the application without giving reasons.

Cooperation with brokers: I acknowledge that, for applications it receives from a broker, the financing institution may exchange with that broker the information necessary in connection with the application and creditworthiness check as well as the conclusion and administration of the contract (e.g. parameters and result of the application review, delivery of the contract documents, information on the contract status, payment behaviour and balance), and to this extent, if and insofar as necessary, I release the financing institution from banking secrecy.

Information about partners: If I have provided information in the application about my spouse or registered partner (“partner”), I confirm that (i) I have informed my partner about this application, (ii) the financing institution may verify the above information by contacting my partner directly, and (iii) my partner agrees that the financing institution may obtain information concerning them as described above (including making informative enquiries with the ZEK).

Data processing: I acknowledge that the financing institution may process my data in order to review my application and for risk assessment and marketing purposes (data analysis and profiling). In addition, other products and services, including those of group companies of the financing institution and other third parties, may be offered to me by post or telephone. I may object to this processing of data for marketing purposes at any time. By providing my email address, I also agree that the financing institution may send me the aforementioned offers by email. In connection with open communication by email, I expressly accept the risk that my data may be intercepted or disclosed by third parties during transmission, or that unauthorised third parties may infer a contractual relationship between the financing institution and me, and that to this extent confidentiality and banking secrecy cannot be guaranteed. I may withdraw my consent to receiving advertising electronically at any time.

Cooperation with service providers (outsourcing): I acknowledge that the financing institution may outsource services to third parties (“service providers”), in particular in the areas of business process handling, IT security and system control, market research and development, the calculation of business-relevant credit and market risks, and the administration of contractual relationships (e.g. application and contract processing, debt collection, communication with customers). The financing institution provides these service providers with the data necessary to fulfil the contractual obligations and may also transfer this data abroad for that purpose. Service providers, their employees and subcontractors are contractually bound to confidentiality by the financing institution. The service providers are generally located in Switzerland or the EU/EEA, but may in principle be based anywhere in the world. If personal data is transferred to a country that, from the Swiss perspective, does not have an adequate level of data protection, the financing institution ensures adequate data protection through appropriate safeguards, such as agreeing standard contractual clauses. I acknowledge that communication between the financing institution and me or the broker may take place via electronic channels. The broker and the financing institution cannot guarantee the confidentiality of data transmitted over the internet. Third parties may therefore be able to infer an existing or prospective business relationship (possibly a banking relationship) between me and the financing institution.
